On February 26, 2022, the DOT published a Notice of Proposed Rulemaking (NPRM) that would allow oral fluids as a valid drug testing specimen type under 49 CFR Part 40. The NPRM also includes provisions to update Part 40 and harmonize, as needed, the regulations with the Mandatory Guidelines for Federal Workplace Drug Testing Programs using Oral Fluids published by the Department of Health and Human Services in October of 2019.

During this webinar, we will discuss the changes proposed by the DOT in this NPRM and how they might impact your testing program.

The proposed changes to Part 40 include:

  • Changes to who can do a direct observation collection
  • Changes to the SAP interview process
  • Allowing the MRO staff to verify donor’s prescriptions
  • Reduce the amount of time a laboratory must store a non-negative specimen
  • Allow the MRO to “un-cancel” a test that was canceled by the MRO in certain situations
  • Other administrative changes

The Federal Aviation Administration (FAA) published its final rule, which will impact everyone.

During this webinar FSSolutions’ Marc Bourne, LPI, CCIP and Shawn P. O’Neil, CSAPA, will discuss the existing PRIA program, how it will transition to the new PRD regulation and how FSSolutions can assist you with compliance in this space.

On June 10, 2021, the Federal Aviation Administration (FAA) published its final rule establishing the requirements for the Pilot Records Database (PRD). The PRD requirements outlined in the newly formed 14 CFR Part 111 will require applicable users to enter and search for the following information:

  • Drug and Alcohol testing records
  • Training, qualification, and proficiency records
  • Final disciplinary action records
  • Final separation from employment records
  • Verification of motor vehicle records search and evaluation

Dr. Barnett conducted a research study for a federal railroad to assess the effects of excessive daytime sleepiness and has had the results published in the Journal of Health and Productivity.
